This applies when you visit our Sites, purchase products, subscribe to our mailing lists, newsletters, and promotional updates, share your memories, or otherwise interact with us through our websites, social media pages, email, text, mail, or offline business interactions (collectively, our “Services”).

Pophouse is committed to protecting your personal privacy. We always strive to process your personal data with care and responsibility under applicable data protection laws, including the General Data Protection Regulation (GDPR).

1. Who is Responsible for Your Personal Data?

You can contact us at any time with questions regarding our processing of your personal data. Our contact details can be found below under Section 14: Contact Information.

2. What Are “Personal Data” and “Processing”?

  • Personal Data: Any information that can be directly or indirectly linked to a living individual. This includes your name, email address, pictures, phone number, or purchase history. Encrypted data and electronic identifiers—such as an IP address or information about your computer/mobile device—are also personal data if they can be linked to you.

  • Processing: Any type of handling of personal data, including collecting, storing, using, sharing, deleting, and modifying it.

  • Legal Basis: All processing requires a legal justification. This may include the fulfillment of a contract, our legitimate interest, your explicit consent, or a legal obligation.

3. What Personal Data May We Collect?

We collect personal data about you in the following ways:

  • Data You Provide to Us: Information you voluntarily give us when you fill out forms, share your memories, place a purchase, subscribe to mailing lists, register for events, participate in promotions/surveys, or upload content. This includes your name, email address, physical address, phone number, picture/media files, date of birth, or other text descriptions.

  • Data We Automatically Collect: Technical information collected when you access the Sites, including your IP address, browser type and version, operating system, access times, geolocation data (via IP location services), and clickstream details (such as the full URL path and pages viewed).

  • Cookies and Tracking Technologies: We use cookies and pixels to distinguish you from other users, personalize content, and analyze web traffic.

  • Behavioral and Interaction Data: Information based on your interactions with our online stores, including products you searched for, items added to your shopping cart, and navigation patterns. This allows us to provide personalized product suggestions or send reminders if you abandon a search or cart.

4. What is the Purpose of Processing Your Data?

We use your personal data to:

  • Send you newsletters, promotions, and special offers tailored to your interests regarding the Avicii brand and relevant Pophouse initiatives.

  • Administer and fulfill purchases made via the Sites.

  • Respond to your queries and provide customer support.

  • Host, manage, and display user-generated content on our platforms, utilizing uploaded fan pictures and memories in accordance with our Terms of Use (e.g., on our Sites, social media, or in marketing and merchandising materials).

  • Operate, personalize, maintain, and secure the Sites.

  • Analyze trends and usage statistics to optimize your user experience.

  • Provide relevant product recommendations and timely reminders to complete your journey on the Sites.

  • Identify and prevent fraudulent transactions or security threats.

5. What is Our Legal Basis for Processing?

We process personal data based on the following legal grounds:

  • Consent: When you voluntarily subscribe to our mailing list, register for updates, accept cookies, or explicitly opt-in to marketing communications. You can withdraw your consent at any time.

  • Legitimate Interest: To manage our relationship with you, operate and secure our Sites, and provide tailored marketing. This includes profiling your behavior (like analyzing search history or cart activity) to enhance your shopping experience. You may object to or request restriction of this processing at any time.

  • Performance of a Contract: When processing is necessary to fulfill an agreement with you or take steps prior to entering a contract. For example, when you buy a product, we must process your data to ship it. This also applies when you upload a picture or memory; we process this data to fulfill our agreement with you under our Terms of Use.

  • Legal Obligation: When we must comply with applicable law, including corporate accounting rules and other regulatory requirements.

6. How Long Do We Store Your Data?

We retain the information we collect only for as long as is reasonably necessary to fulfill the purposes set out in this Privacy Policy, or as strictly required by law.

7. Spotify Account Linking

If you choose to link your Spotify account to your Avicii Community account, we will be able to view specific Spotify account data:

  • Your email address.

  • Your Spotify subscription type, account country, and explicit content filter settings.

  • Your name, username, profile picture, Spotify followers, and public playlists.

  • Your recent Spotify activity (including recently played content and collaborative playlists).

Legal Basis & Retention: The legal basis for this processing is your consent. You can withdraw consent at any time by removing access to your Spotify account within your account settings. We process this data for as long as your Spotify Connect link is active, and up to five (5) days after you remove access.

8. Who Might We Share Your Personal Data With?

We may share your information with selected third parties under the following circumstances:

  • Pophouse Group Companies: Within the Pophouse Entertainment Group (including subsidiaries and affiliates).

  • Third-Party Service Providers: Trusted partners performing services on our behalf, such as email delivery/newsletters, hosting, data analysis, marketing assistance, merchandise fulfillment (processing and shipping orders), and customer service support.

  • Strategic Business Partners: To preserve, promote, and celebrate the musical legacy of Avicii, Pophouse collaborates closely with partners in the music industry. In some instances, these partners act as independent data controllers, meaning they determine their own processing purposes. Please refer to their specific privacy policies to understand how they handle your data.

  • Corporate Transfers and Legal Obligations: Pursuant to a court order, subpoena, or legal process, or as part of an actual or potential corporate sale, merger, acquisition, or asset transfer.

We only share data to the extent necessary and never share more data than required or consented to.

9. Social Media and External Links

Our Sites contain integrated social media tools, plug-ins (e.g., Instagram, YouTube, Facebook), and links to external websites like the Tim Bergling Foundation. Clicking on these links allows third parties to collect your data under their own rules. We do not control these third parties, and their processing is governed entirely by their respective privacy policies.

10. International Data Transfers

We aim to process your personal data within the EU/EEA. However, because we work with global service providers and partners, your data may sometimes be transferred to countries outside the EU/EEA (such as the United States). When this happens, we implement appropriate safeguards, including:

  • Transferring data to countries officially recognized by the European Commission as providing an adequate level of data protection.

  • Utilizing Standard Contractual Clauses (SCCs) approved by the European Commission, which bind the receiving entity to the same protection standards required within Europe.

11. How We Protect Your Data

Pophouse takes appropriate technical and organizational measures to protect your personal data from unauthorized access, loss, destruction, or alteration. We follow industry standards and best practices to ensure secure data handling.

We use cookies, pixels, and similar tracking technologies (collectively, “Cookies”) to distinguish you from other users, improve our Sites, and deliver tailored content or advertising.

What are Cookies and Pixels?

  • Cookies: Small text files stored on your device (computer, phone, tablet) that remember your settings, enhance site performance, and track user behavior.

  • Pixels: Invisible code snippets loaded from external servers used to measure ad effectiveness or link your activity to social media platforms.
